All maintained (state) schools, primary and secondary can apply to the Department of Education to convert to become an Academy (including selective and faith designated, and special schools).

The process will include:

  • Establishing Academy Trust (its governing documents).
  • Undertaking consultation.
  • TUPE transfer (dealing with all employment issues).
  • Documentation – transfer/grant of property interests – transfer of business and assets to Academy (can include substantial asset transfer that involves advice on liability and risk).
  • Negotiate funding agreements with the Department of Education.
  • Each school is likely to have individual requirements that need resolving: it may be a foundation school with or without a foundation, it may have complicated property and land ownership issues to resolve or it may be part way through a building schools for the future project.
  • LCF provides legal advice and support for the school and its governing body including setting up the trust and preparing and negotiating all contractual documentation including the funding, transfer of land and other contractual agreements.

We will work with the Schools and governors to plan and implement the process through to a successful conclusion.
